NYC officials say they will not clean up Canal Street counterfeit market

New York City officials announced on Oct. 9 that the city will not take action to clean up the overt counterfeit market that occupies Canal Street in lower Manhattan.

The decision was highlighted by City Journal reporter Daniel Edward Rosen, who noted that the market operates in plain sight because of inconsistent policing, lax prosecution and an "unreasonably high legal bar" for felony counterfeiting charges. Prosecutors must prove that the retail value of genuine versions of the fake goods exceeds $100,000 before a felony can be pursued, a threshold that has kept felony arrests rare.

City officials also pointed to a March repeal of criminal penalties against unlicensed vendors, shifting enforcement of street vending to civil violations handled by the Departments of Sanitation and Consumer and Worker Protection. Under the new framework, the NYPD intervenes only when vendors ignore direct orders to clear the sidewalk or when state trademark laws are violated at the $100,000 threshold.

Law enforcement officers have struggled to maintain a sustained presence on Canal Street, and the city’s posture on vending generally is moving toward less enforcement rather than more. Critics argue that the lack of action undermines public safety and consumer protection, allowing the sale of fake designer goods to continue unchecked.

Mayor Zohran Mamdani’s Transportation Department has responded by installing “super sidewalks,” narrowing the street and adding painted footpaths. Officials hope the redesign will improve pedestrian flow, but they acknowledge that vendors may simply occupy the new frontage.

The city’s stance reflects broader challenges in enforcing intellectual property laws in a bustling urban environment, where legal thresholds, resource constraints and recent policy shifts combine to limit the ability to target counterfeit operations.
